For this purpose, the user&#8217;s IP address must remain stored for the duration of the session. The purpose of storage in log files is to ensure the functionality and stability of the website. In addition, the data serve us to optimize the website and to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context. These purposes also constitute our legitimate interest in data processing according to Art. 6 (1) lit. f GDPR.       <\/p>\n<p>Duration of storage: The data are deleted as soon as they are no longer required to achieve the purpose for which they were collected. Contact form and email contact<br \/>Description and scope of data processing: By submitting a contact request via our contact form, the data entered in the input mask are transmitted to us and stored. You are not obliged to provide us with personal data. The data will be used exclusively for processing the conversation. <\/p>\n<p>Legal basis for data processing: The legal basis for processing data transmitted via the contact form or in the course of sending an email is Art. 6 (1) lit. f GDPR. Our legitimate interest lies in answering the sender&#8217;s contact request. If the email contact aims at the conclusion of a contract, the additional legal basis for processing is Art. 6 (1) lit. b GDPR.      <\/p>\n<p>Purpose of data processing: The processing of personal data from the input mask serves us solely to process the contact request. The other personal data processed during the sending process serve to prevent misuse of the contact form and to ensure the security of our information technology systems. <\/p>\n<p>Duration of storage: The data are deleted as soon as they are no longer required to achieve the purpose for which they were collected. For the personal data from the input mask of the contact form and those sent by email, this is the case when the respective conversation with the user has ended, provided that no contractual or legal obligations prevent deletion. The conversation is ended when it can be inferred from the circumstances that the matter in question has been conclusively clarified.  <\/p>\n<p>The personal data additionally collected during the sending process will be deleted after a period of seven days at the latest.<\/p>\n<p>V. Online apartment application<br \/>Description and scope of data processing: On our website, through the service provider Wohnungshelden commissioned to carry out the apartment application process, we offer interested parties the opportunity to specify an apartment request and create a search order for this by providing personal data such as contact details and entering the desired search parameters. We store your contact details and your search parameters in order to send you search results that are of interest to you. We also offer users on our website the opportunity to apply online as a tenant of an apartment\/commercial property by providing personal data or to download a corresponding application form and a template for a certificate from the previous landlord. In the case of an online application, the data are entered into an input mask and transmitted to us and to the service provider Wohnungshelden and stored; in addition, required evidence for the information is uploaded as PDF, JPG, or PNG files, transmitted to us and Wohnungshelden, and stored by us and Wohnungshelden.   <\/p>\n<p>In principle, the data are only passed on to those departments of our company that need the data to answer the application or to implement a rental agreement, such as accounting. Data is passed on outside our company, on the one hand, to the service provider Wohnungshelden, whom we have commissioned to handle the application process for an apartment with us, as well as to public bodies that receive data based on legal regulations (in particular social security carriers, tax authorities); furthermore, insofar as this is necessary for the fulfillment of a rental agreement or to safeguard our legitimate interests, to service providers (such as credit institutions or tax consultants). <\/p>\n<p>Should we have decided on you as a rental agreement party, i.e., immediately before the conclusion of the rental agreement, we are also entitled, on the basis of the transmission of data within the framework of the apartment application, to obtain information from SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden (&#8220;SCHUFA&#8221;), about the creditworthiness of the prospective tenants specified in the application and about the existence of so-called negative characteristics, and for this purpose also to pass on the names, dates of birth, and addresses of the prospective tenants to SCHUFA. Negative characteristics are characteristics that usually stand in the way of granting credit or restrict it extensively (e.g., ongoing debt collection proceedings, insolvency, affidavit, above-average risk of bad debt, or similar, hereinafter: &#8220;negative characteristics&#8221;). The SCHUFA query is handled via an interface from Wohnungshelden with SCHUFA. Creditworthiness is determined and presented by SCHUFA in the form of probability values, including on the basis of information on previous payment behavior and creditworthiness information based on mathematical-statistical methods using address data. Such information provided to us may be stored by SCHUFA if necessary.    <\/p>\n<p>At the time of the online application, the following data are also stored:<\/p>\n<p>The user&#8217;s IP address<br \/>Date and time of registration<br \/>Within the framework of the online application, the user&#8217;s consent to the processing of these data is obtained, without which it is not possible to send the application.<\/p>\n<p>Legal basis for data processing: The legal basis for processing the data, if the user has given consent, is Art. 6 (1) lit. a GDPR. When collecting and storing contact details and search parameters within the framework of the search order, the legal basis is Art. 6 lit. b GDPR (implementation of pre-contractual measures). Furthermore, the application also serves the fulfillment of a contract to which the user is a party or the implementation of pre-contractual measures, which is why Art. 6 (1) lit. b GDPR is also an additional legal basis for processing the data here.       <\/p>\n<p>Purpose of data processing: The purpose of processing within the framework of the search order is the provision and dispatch of individual offers and search results. The user&#8217;s application is necessary for the establishment of a rental agreement between us and the user or for the implementation of pre-contractual measures. The data collected are used to determine a suitable apartment for the user and to inform the user about this. If a rental agreement is concluded, the user&#8217;s personal data \u2013 in particular: surname, first name, and previous address \u2013 will be transferred into this agreement.   <\/p>\n<p>Duration of storage: The data are deleted as soon as they are no longer required to achieve the purpose for which they were collected. For the data provided within the framework of the search request, this is the case as soon as you inform us that you are no longer interested in individualized offers. For the data collected within the framework of the application, this is the case when the data are no longer required for the conclusion or implementation of a rental agreement; also if the user informs us that they are not maintaining their application. In cases where prospective tenants can demand claims for the elimination of discrimination according to \u00a7 21 AGG (General Act on Equal Treatment), the data are regularly deleted after six months at the latest, provided that no further assertion of claims is possible. If the data are required for the fulfillment of a contract or for the implementation of pre-contractual measures, premature deletion of the data is only possible insofar as contractual or legal obligations do not prevent deletion.    <\/p>\n<p>VI. A contract has been concluded with Google according to the EU standard contractual clauses to ensure an adequate level of data protection when transmitting personal data to third countries. Please also note Google&#8217;s privacy policy here at https:\/\/policies.google.com\/privacy?hl=en.  <\/p>\n<p>We use Google Maps to visually display geographical information. When using Google Maps, Google also collects, processes, and uses data about the use of map functions by visitors. We would like to expressly point out that we have no influence on the further use of data collected by Google. To our knowledge, your personal data will be transmitted to the USA. We hereby wish to draw your attention to the fact that the USA does not offer a level of data protection comparable to European data protection law. Automated decision-making including profiling<br \/>No automated decision-making including profiling takes place at BGH itself. However, for the decision as to whether a rental agreement is concluded with an interested party, we use information about the creditworthiness of the interested party transmitted to us by SCHUFA Holding AG, which is determined in the form of probability values, including on the basis of information on previous payment behavior and creditworthiness information based on mathematical-statistical methods (cf. Section V). <\/p>\n<p>X. Video surveillance<br \/>Description and scope of data processing: Parts of our rental properties are under video surveillance. The image data collected and the date and time of the recording are transmitted to us and stored. <\/p>\n<p>Video surveillance is not legally required. You are not obliged to provide us with the image data. However, it is not possible to enter video-monitored areas of the rental properties without those entering being subject to video surveillance in these areas. For this reason, we generally cannot conclude a contract with tenants who do not wish to be subject to video surveillance.   <\/p>\n<p>With the exception of image recordings that show behavior relevant under criminal law and which we transmit to the law enforcement authorities (police, public prosecutor&#8217;s office), the data are not passed on to third parties.<\/p>\n<p>Legal basis for data processing: The legal basis for processing data transmitted via video surveillance is primarily the consent given by tenants, Art. 6 (1) lit. b GDPR, otherwise \u2013 also with regard to third parties who are not tenants \u2013 Art. 6 (1) lit. f GDPR. Our legitimate interest in video surveillance lies in making our rental properties safe for tenants and third parties and preventing damage from vandalism. Should criminal offenses be committed, video surveillance supports their investigation. Video surveillance is also an expression of our domiciliary rights in the rental properties.       <\/p>\n<p>Purpose of data processing: The processing of data collected through video surveillance serves exclusively the prevention and investigation of criminal offenses and the protection of our and others&#8217; property.<\/p>\n<p>Duration of storage: The personal data collected within the framework of video surveillance are deleted as soon as they are no longer required to achieve the purpose for which they were collected. This is usually the case after seven days at the latest, if it is established that no recordings relevant under criminal law were made that are to be investigated; in this case, the data remain stored until they are no longer needed for the investigation. <\/p>\n<p>XI. Photo competitions<br \/>Description and scope of data processing: BGH conducts photo competitions. Eligible participants can submit a photo in these competitions that was taken in or at a BGH building. Three of the submitted photos will be awarded prizes and published on the BGH website and in the tenant magazine &#8220;Biber&#8221;. By submitting a photo, the participant accepts the conditions for participation in the photo competition and, in the event that their picture is awarded a prize, agrees to the publication of the picture and their surname. We provide the form for participation in the photo competition for you to download on our website. The transmitted data will be stored by us and archived until the end of the competition.     <\/p>\n<p>Please note that we generally only accept images showing people for participation in the photo competition if you provide us with a written declaration signed by each of the persons depicted that meets the requirements of the GDPR \u2013 which in particular also contains the information according to Art. 13, 14, and 21 GDPR \u2013 and which shows that the persons depicted agree both to the personal data contained in this declaration being sent to us and to the publication of the photo on which they are depicted on the BGH website and in the tenant magazine &#8220;Biber&#8221;.<\/p>\n<p>Legal basis for data processing: The legal basis for processing data transmitted within the framework of the photo competitions is the consent given by the participants and the persons depicted, Art. 6 (1) lit. b GDPR.  <\/p>\n<p>Purpose of data processing: The purpose of processing data transmitted within the framework of the photo competitions is to make BGH and its buildings known and to promote them.<\/p>\n<p>Duration of storage: The personal data collected within the framework of the photo competitions are deleted as soon as they are no longer required to achieve the purpose for which they were collected. This is the case after the conclusion of the competition and the dispatch of the prizes with regard to the non-winning photos. With regard to the winning photos, the data remain stored for documentation and verification purposes until the expiry of the statutory retention periods.  <\/p>\n<p>XII. Surveys and competitions<br \/>Description and scope of data processing: To maintain and improve our service quality, we occasionally conduct surveys among our tenants or other groups of people. As an incentive, we occasionally combine participation in a survey with a competition. The evaluation of answers within the framework of surveys is generally anonymous, i.e., BGH cannot assign the answers to any persons. If the survey is not evaluated anonymously and personal data are collected by us, we will expressly point this out to you.   <\/p>\n<p>In the case of online surveys, the data and information listed under Section III are automatically collected from the computer system of the accessing computer. These data and information are not linked to answers from surveys. <\/p>\n<p>As a rule, we use technical and other service providers to conduct surveys, who process the participants&#8217; data exclusively in accordance with instructions within the framework of order processing contracts.<\/p>\n<p>If you wish to participate in a competition, we collect your email address and\/or other contact details in order to be able to determine the winner. We will provide details of data processing separately in the terms and conditions of participation for the competition if necessary. <\/p>\n<p>By participating in a survey, you give your consent to the data processing associated with the conduct and evaluation of the survey. For participation in a competition, we obtain your separate consent. <\/p>\n<p>Legal basis for data processing: The legal basis for data processing is your respective consent according to Art. 6 (1) lit. a GDPR and our legitimate interests according to Art. 6 (1) lit. f GDPR. The processing of the automatically collected data and information listed under Section III is strictly necessary for the operation of the survey website. Our legitimate interest lies in maintaining the functionality of the website.        <\/p>\n<p>Purpose of data processing: Data processing serves to conduct the survey and, if applicable, the competition.<\/p>\n<p>Duration of storage: If personal data are stored for participation in the competition, these will be deleted as soon as the competition has been completed and the prizes have been sent. We provide further information on the storage period in the conditions for participation in the survey and the competition. <\/p>\n<p>XIII.
